Terms of service
1. Definitions
1.1 Buyer: the individual or organisation who buys or agrees to buy Goods from the Seller.
1.2 Consumer: has the meaning given in section 2(3) of the Consumer Rights Act 2015 (and, where relevant, section 12 of the Unfair Contract Terms Act 1977).
1.3 Contract: the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms of Service.
1.4 Goods: the items that the Buyer agrees to buy from the Seller (including made‑to‑order furniture).
1.5 Seller: Vintage Sofa Makers, a trading subsidiary of Birch & Hide Ltd (Company No. 16688646), registered office 5 Brayford Square, London, E1 0SG which owns and operates www.vintagesofamakers.co.uk.
1.6 Terms of Service: these terms and any special terms agreed in writing by the Seller.

2. Conditions
2.1 Nothing in these Terms affects the Buyer’s statutory rights as a Consumer.
2.2 These Terms apply to all Contracts for the sale of Goods by the Seller to the Buyer and prevail over any other documentation or communication from the Buyer.
2.3 Placing an order constitutes acceptance of these Terms.
2.4 Any variation to these Terms is inapplicable unless agreed in writing by the Seller.

3. Ordering
3.1 All orders are an offer by the Buyer to purchase Goods pursuant to these Terms and are subject to acceptance by the Seller. The Seller may decline an order for any reason (including pricing or description error, stock/material availability, payment issues, or suspected fraud).
3.2 Most Goods are made to order. If a material or component becomes unavailable, we will advise options (alternative, revised lead time, or cancellation with a full refund).

4. Price & Payment
4.1 Prices are shown in GBP. Unless stated otherwise, prices include UK mainland delivery. We are not currently VAT registered; no VAT is charged.
4.2 The total purchase price and any surcharges (if applicable) are shown before you confirm your order.
4.3 After receiving your order, we will email an Order Confirmation setting out details, description and price of the Goods.
4.4 Payment in full is required at the time of order and prior to scheduling delivery.
4.5 Title to the Goods passes to the Buyer only once payment is received in full. Risk passes on delivery (see clause 7.8).
4.6 We may use payment security checks (e.g., CVV/CVC verification, 3‑D Secure).
4.7 Discounts or promotional offers apply per order and delivery address, one discount per order, unless otherwise agreed in writing. Bespoke alterations are excluded from discounts unless agreed.
5. Rights of the Seller
5.1 We may periodically update prices on the Website; prices cannot be guaranteed for any period prior to order placement.
5.2 We may withdraw Goods from the Website at any time.
5.3 We shall not be liable to anyone for withdrawing any Goods or refusing to process an order prior to acceptance.
6. Product Specifications
6.1 We reserve the right to amend the specification of Goods for future sales without prior notice.
6.2 Our leathers and fabrics are natural materials; colour, grain and texture may vary. Natural marks and scars are characteristic, not defects. Some patina and mellowing over time are expected; colours may fade with sunlight or heat.
6.3 We endeavour to match fabric/leather shades, but batch variations occur and are outside our control.
6.4 Dimensions are handmade and therefore approximate (±2 cm).
6.5 Colours shown online may differ from real life due to device/screen variation and the nature of materials.
7. Delivery
7.1 Deliveries offered by the Seller and its partners are limited to UK mainland (Great Britain) addresses. Exclusions: Channel Islands and Isle of Man. See Shipping Policy for Highlands/Islands, NI & ROI arrangements (customer‑paid/arranged where applicable).
7.2 Where an order contains more than one item, we generally deliver together once all are ready. Part‑delivery may be available; additional charges may apply.
7.3 Made‑to‑order lead time: typically ~4 weeks, extending to up to 6–7 weeks during busy periods. We will advise the best estimate at order acceptance.
7.4 For deliveries outside our included area, we can deliver to a nominated GB‑mainland hub/port for onward shipping arranged and paid by the Buyer. The Buyer (or agent) must inspect and sign for the Goods prior to onward carriage; risk transfers upon such handover.
7.5 If a specific delivery date is agreed and cannot be met, we will notify you and agree a new date.
7.6 We use reasonable endeavours to meet delivery estimates, but time is not of the essence. We are not liable for losses or expenses arising from delay beyond our reasonable control.
7.7 Delivery is to the address specified in the order. The Buyer must ensure access and be available to take delivery. The Seller and the delivery company are not liable for property damage where access is unsuitable or measurements were not checked (see Shipping Policy).
7.8 Risk in the Goods passes on delivery (or attempted delivery where the Buyer is unavailable at the confirmed time). Ownership passes once payment is received in full.
7.9 If you are unable to take delivery on the confirmed date, a redelivery fee may apply.
8. Cancellation & Returns
8.1 Consumers may cancel an order in writing (email) for any reason within 30 days of delivery. Same‑day refusal at delivery is free (see 8.2.2). Bespoke/custom goods (non‑standard sizes, special‑order leathers/fabrics, or other personalisation) cannot be cancelled after the initial payment and cannot be returned after delivery, unless faulty.
8.2 Refunds are processed after the Goods are received and inspected at our workshop. We aim to refund within 5–10 business days after inspection via the original payment method.
8.2.1 The Buyer must allow the Seller access to collect Goods within 14 days of cancellation where applicable.
8.2.2 Same‑day return with the delivery team: No collection charge; a full refund will be issued subject to inspection.
8.2.3 Returns after delivery (within 30 days): An £80 collection charge applies. Goods must be in original packaging where reasonably possible and in clean, saleable condition. Damage, odours, stains or excessive wear may incur repair/cleaning deductions (see Return & Refund Policy).
8.3 The Buyer should inspect Goods on receipt and notify the Seller within 48 hours of any transit damage. For other issues, please contact us within 30 days. Failure to notify within these periods may affect the remedies available.
8.4 Where a claim of defect is made under statutory rights, the Seller will repair, replace or refund as appropriate under the Consumer Rights Act 2015.
8.5 Outlet/clearance items: where sold as seen and viewed in person, they may be non‑returnable unless faulty; where purchased remotely, statutory cancellation rights apply but collection charges and condition requirements may apply.
8.6 All Goods must be returned in the condition delivered. Damage attributable to the Buyer may result in chargeable remedial costs.
8.7 Frame guarantee: 25‑year guarantee against reasonable wear to the frame under normal domestic use. Non‑transferable. Other components and accessories (e.g., footstools, cushions) may carry different terms communicated at sale.
8.8 We are not responsible for discolouration/fading from sunlight/heat or damage caused by misuse, improper cleaning, pets, or failure to follow care guidance.
9. Guarantees & Liability
9.1 Guarantee coverage requires full payment and applies to Goods located on the UK mainland, under normal domestic use, and subject to routine care. Commercial use must be declared; modified terms may apply.
9.2 Damage arising from misuse (staining, burns, pet damage, harsh cleaners), failure to maintain, or prolonged sunlight exposure is excluded.
9.3 The guarantee period begins on the delivery date. The guarantee is non‑transferable and applies only to the original Buyer.
9.4 To assess a guarantee claim, we may request photographs, videos, or an inspection.
9.5 Nothing limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under UK law.
9.6 Subject to 9.5, our total liability arising out of or in connection with a Contract shall not exceed the price paid for the Goods; we are not liable for indirect or consequential losses or loss of profit.
10. Intellectual Property & Website Use
10.1 The Website is provided on an “as is” basis. We make reasonable efforts to ensure accuracy but do not warrant that content is error‑free.
10.2 All site content (images, text, designs) is our intellectual property or used under licence. Do not reproduce without permission.
10.3 We are not responsible for third‑party websites that link to or from our Website.
11. Waiver
No waiver by the Seller of any right under these Terms shall prejudice its right to enforce the same in the future.
12. Force Majeure
We are not liable for delay or failure to perform obligations due to events beyond reasonable control (including but not limited to extreme weather, strikes, transport disruption, fires, epidemics, or raw‑material shortages). A reasonable extension of time will apply.
13. Severance
If any provision is held invalid, illegal or unenforceable, that provision shall be severed and the remainder shall continue in full force and effect.
14. Insolvency of Buyer (non‑consumer)
If the Buyer enters insolvency as defined by applicable law (including administration, liquidation, bankruptcy, receivership) or the Seller reasonably apprehends such events, the Seller may cancel the Contract or suspend deliveries. If Goods have been delivered but not paid for, the price becomes immediately due and payable.
15. Changes to These Terms
We may alter these Terms from time to time. The version posted at the time of your order applies to that order.
16. Governing Law & Jurisdiction
These Terms are governed by the laws of England & Wales. The parties submit to the exclusive jurisdiction of the courts of England & Wales.
